The Kenyan government has introduced comprehensive reforms to its gambling sector through the Gambling Control Bill 2023, aiming to address rising concerns over addiction, underage betting, and regulatory lapses.
Key Provisions of the Gambling Control Bill, 2023:
- Establishment of the Gambling Regulatory Authority: A new body replacing the Betting Control and Licensing Board (BCLB) to oversee all gambling activities, including betting, casinos, lotteries, and media-related promotions.
- Stricter Licensing Requirements: Operators must now hold a minimum of 30% Kenyan ownership and maintain accounts with Kenyan-registered banks. Additionally, online gambling firms and national lotteries are required to deposit KES 200 million as a security measure.
- Enhanced Taxation: A 15% tax on gross gambling revenue has been instituted, up from the previous 7.5%, alongside monthly levies determined by the relevant Cabinet Secretary.
- Minimum Betting Limits: To discourage excessive gambling, a minimum bet amount of KES 20 has been set. Operators allowing bets below this threshold face fines up to KES 5 million.
- Advertising Restrictions: Gambling advertisements are banned on radio and television between 6 a.m. and 10 p.m. to protect vulnerable populations, especially minors.
- Consumer Protection Measures: Operators are mandated to implement advanced age-verification systems, self-exclusion tools, and display responsible gambling messages prominently.
- Penalties for Non-Compliance: Operating without a license can result in fines up to KES 3 million or imprisonment for three years, with harsher penalties for repeat offenders.
Government Initiatives to Support the Reforms:
In tandem with the legislative changes, the Ministry of Health has launched a 24/7 helpline (dial 719) to assist individuals struggling with gambling addiction. The government is also collaborating with the Association of Gaming Operators in Kenya (AGOK) to roll out awareness campaigns and conduct studies on the socio-economic impacts of gambling.
